Trusts. Information about inter vivos and testamentary trusts is general only. Trust instruments are lodged with the Master of the High Court where required, and a trustee may act only after the Master gives written authority under the Trust Property Control Act 57 of 1988. You should consult a qualified Islamic scholar and a South African legal practitioner to ensure your estate plan meets both Shari'ah requirements and the formal requirements of the Wills Act 7 of 1953.
