Executor letter template

Use this when an executor is not giving clear estate updates

Fill in the brackets, delete anything that does not apply, send it in writing, and keep proof. Quote the estate number on every version.

  • Send by email and registered post or hand delivery with a signed copy.
  • Keep the tone factual and avoid accusations.
  • Give a 14-day deadline for a written response.
  • Attach proof of identity, relationship, or creditor claim.

Letter to the executor of a deceased estate

1. Who I am

I am [an heir named in the will / a child of the deceased / the surviving spouse / a creditor of the estate] of the late [full names], who passed away on [date]. [If claiming under intestacy: I understand I qualify as an heir in terms of the Intestate Succession Act.]

2. What I am requesting

I kindly request the following in writing within 14 days of this letter:

(Keep only the items you need:)

  • Confirmation of your appointment and a copy of the Letters of Executorship / Letters of Authority;
  • Confirmation of whether a will exists, and whether I am named as a beneficiary in it;
  • A progress update on the administration of the estate, specifically: whether the Section 29 creditors' advertisement has been placed, and whether the Liquidation & Distribution account has been lodged with the Master (and if not, the reason and expected date);
  • Confirmation of when and where the L&D account will lie open for inspection;
  • An estimate of when distribution to heirs is expected to take place;
  • (Creditors:) Acknowledgement of my claim against the estate in the amount of R[amount], supporting documents attached.

3. Why I am writing now

[One factual sentence, e.g.: "It has been [X] months since the estate was reported and I have received no communication regarding its progress." Keep it factual, no accusations.]

4. Next steps

If I do not receive a response within 14 days, I will regretfully have no option but to direct my enquiry to the Master of the High Court, [office], with a copy of this correspondence.

I would far prefer a straightforward update. Thank you for your attention.

Specific, deadline-bound letters get taken more seriously
